Landmark Ruling Secures Conservation Status for Protasiv Yar
The Commercial Cassation Court within Ukraine’s Supreme Court has affirmed the protected status of the Protasiv Yar landscape reserve. This decision came in response to an appeal filed by the civic group "Defend Protasiv Yar," which has been a vocal advocate for preserving the area. The ruling confirms the reserve designation for 16.5 hectares of Protasiv Yar, marking a significant victory in the ongoing effort to safeguard this natural zone.
In 2004, the Kyiv City State Administration granted the firm Protasiv Yar a permit to develop the land. That same year, in July, the Kyiv City Council leased 15 hectares to the limited liability company Protasiv Yar for construction, reclassifying the land from recreational to residential and public use. By October 2004, the council had sold the plot to the firm, sparking outrage among local residents who mobilized against the development. Public hearings held in 2005 later confirmed community opposition to the project.

On April 20, 2021, the Kyiv City Council’s standing committee on environmental policy backed a proposal to establish a landscape reserve. The council formally approved this measure in July 2022, a key milestone in securing the area’s environmental protection. On November 23, 2023, the council voted to name the reserve after Roman Ratushnyi, who died on the front lines near Izium on June 9, 2022. A separate legal case remains ongoing, involving a prosecutor’s lawsuit against the Kyiv City Council and the company Protasiv Yar to return the reserve’s territory to municipal control. The next hearing in that case is scheduled for July 8. Notably, on March 5, 2026, the Northern Commercial Court of Appeal partially overturned the council’s decision to create the Roman Ratushnyi landscape reserve, stripping 16 hectares of green space of its protected status.
