Ukraine's Defense Ministry Clarifies When Medical Commissions Are Mandatory for Those with Deferrals

Confirmation of Mobilization Deferral Status

Ukraine's Ministry of Defense has confirmed that individuals with a valid deferral from mobilization or a job reservation are not required to undergo the Military Medical Commission (VLC). This is governed by Cabinet of Ministers Resolution No. 560, which states that conscripts whose deferral period has not expired are not to be sent for a medical examination.

The ministry further clarified that the procedure for granting a deferral due to job reservation does not involve referral to the VLC. However, the Ministry of Defense reminds citizens of three key exceptions where undergoing the VLC is mandatory:

  • Signing a contract for military service;
  • For individuals with a 'limited fitness' status who have not undergone a re-examination, except for persons with disabilities;
  • A voluntary request for an examination, for instance, due to a deterioration in health.
Attorney Oleksiy Mendrukh commented on the situation, stating: 'The rules are written clearly here. There can be no other interpretation.'

These clarifications from the Ministry of Defense aim to provide clear rules on VLC procedures for conscripts who hold deferrals or reservations. This guidance comes amid ongoing mobilization efforts to support Ukraine's defense against the Russian invasion.

Purpose of the Changes to VLC Procedures

This move by Ukraine's Ministry of Defense is intended to reduce the administrative burden on conscripts who are legally entitled to a deferral or job reservation. Resolving the question of VLC requirements aims to establish clear rules within the mobilization framework, which may help prevent misunderstandings among the public.
