Ukraine introduces new rules for extending disability deferral during martial law. Starting from May 2024, the deferral is granted for the duration of mobilization, which takes place during martial law, with a maximum period of 90 days. Men aged 18 to 60 must extend their deferral every three months at territorial centers of completion.
Lawyer Andriy Topchiy explained that for persons with disabilities, especially under the need to confirm it under new rules, the law provides for the automatic transfer of data from state registers to territorial centers of completion. Such individuals do not need to apply in person with documents.
Men aged 25 to 60 who have the second or third disability group are required to undergo assessment of everyday functioning according to established deadlines. Those who had their disability established before the law was enacted and did not undergo a re-examination at medical commissions during martial law can automatically extend the deferral through Reserve Plus or apply to the Pension Fund management.
Conducting re-examinations for persons with disabilities
The Ministry of Health of Ukraine informs that all who have limitations in everyday functioning and disability status will undergo assessment by a team of experts. If the disability is established indefinitely, undergoing an assessment is not mandatory, only at the individual's wish.
Persons who cannot undergo a re-examination for objective reasons are provided with specified exceptions. These may include individuals in combat zones or temporarily occupied territories, or those who have severe functional impairments. For active military personnel, the disability status remains during their service and for 60 days after discharge.
