Ukraine's Parliament Considers Bill to Lift Pension Caps for Military and Security Personnel

Депутати обговорюють зміни до законодавства, які можуть підвищити пенсії для військових та представників силових структур.

Draft Law 15090-1 Submitted to Parliament

A legislative proposal, registered as Draft Law 15090-1, has been submitted to Ukraine's Verkhovna Rada. This bill seeks to eliminate caps and reduction coefficients applied to maximum pensions exceeding 25,000 hryvnias for military personnel, individuals in the security and defense sectors, and their families. The draft has been forwarded to the relevant parliamentary committee for review and proposes amendments to the law 'On Pension Provision for Persons Discharged from Military Service and Some Other Persons'.

Scope and Impact of the Proposed Changes

The new rules would abolish the current limit on pension recalculations, regardless of the date of discharge. The changes would apply to service members who have accrued the required length of service or who became disabled while performing their duties. The initiative also extends to retirees from the security bloc and their family members.

This legislative move comes in a context where Ukrainian courts have issued approximately 750,000 rulings deeming the government's and Pension Fund's actions unlawful. Currently, for 2026, the maximum pension under special laws is capped at 25,950 hryvnias, equivalent to ten subsistence minimums for disabled citizens. Amounts exceeding this threshold are subject to a reduction coefficient of 0.5. As the draft's authors note,

'court practice over the past decade has consistently recognized such state actions as unlawful.'

If passed, this bill could significantly improve the financial situation of military and security service veterans by ensuring fairer pension provisions. This reform is seen as a critical step toward addressing long-standing social issues for veterans and their families affected by payment restrictions, aligning state policy with established judicial precedent.

As discussions around pension reforms continue, a recent legal shift has opened the door for potential recalculations for military retirees. This change aligns with the ongoing efforts to address the financial challenges faced by veterans and their families.
