Changes in the procedure for protecting the rights of property owners and businesses

From January 1, 2026, the procedure for protecting the rights of property owners and businesses in Ukraine will change, introducing new rules for appealing decisions made by state registrars. The main structural change is the abolition of the old Committees for considering complaints. Instead, newly created Commissions will handle these issues, aimed at increasing the efficiency and transparency of the process.

According to the new rules approved by the Cabinet of Ministers of Ukraine in resolution No. 420, not only the decisions of territorial bodies of the Ministry of Justice of Ukraine are subject to appeal, but also the automated actions of software. Cases of hacking registrars' keys have also been included in the list of grounds for filing a complaint. Order No. 71/5 from 2020 loses its validity, indicating significant changes in the approaches to regulating this area.

Procedural changes and their significance

Procedural changes stipulate that interested parties become full participants in administrative proceedings. An important innovation is the prohibition of re-examining a complaint if the court has annulled the decision of the Ministry of Justice. The Ministry of Justice is obliged to comply with the court's decision after it has gained legal force, emphasizing the importance of judicial control in this area.

These changes are designed to make the procedure for appealing real estate decisions more accessible and understandable for citizens, as well as to enhance the level of protection for property owners' rights.

The implemented changes to the procedure for appealing decisions of state registrars are an important step towards reforming the system of protecting the rights of property owners and businesses in Ukraine. It is expected that the new rules will contribute to reducing bureaucratic hurdles and increasing citizens' trust in state institutions. These initiatives may become the basis for further improvement of the legal framework in the real estate sector, which is a vital aspect for the investment climate in the country.
