Overview of Special Property Rights in Ukrainian Mortgage Market

The recent introduction of special property rights within mortgage agreements in Ukraine has aimed to transform investing in unfinished residential properties into a legally secure venture. Despite this advancement, bureaucratic hurdles and a shortage of new development projects have limited this tool's reach to just 2% of the real estate market. Expanding mortgage accessibility will require legal reforms, including standardized documentation procedures, implementation of escrow accounts, and the establishment of a Construction Guarantee Fund.

Although Ukraine's primary real estate market now recognizes special property rights in mortgages, several critical challenges remain:

  • Lack of mandatory comprehensive legal documentation during the construction phase;
  • Complex transaction processes that increase risks for investors;
  • Absence of escrow accounts, raising concerns about the security of investments in new developments.

An essential missing component is the Construction Guarantee Fund, which would mitigate risks by ensuring projects reach completion even if developers face difficulties.

Olena Fomenko, Chief Economist at the National Bank of Ukraine's Financial Stability Department, emphasized: 'While special property rights have laid a solid legal foundation, the market urgently needs financial guarantees for project completion. Only then will primary real estate investments become safe for both investors and banks.'

To foster a more secure and trustworthy environment for all market participants, the implementation of these mechanisms is crucial for improving Ukraine's primary real estate sector.

Future Outlook for Ukraine's Real Estate Market

The adoption of special property rights in mortgages holds significant potential to reshape Ukraine's real estate landscape. Overcoming current obstacles through legislative updates and the introduction of financial safeguards could stimulate market growth and boost investor confidence. Such progress is expected to lead to increased construction activity and enhance housing conditions for the population.
