According to ХВИЛЯ: In the conditions of martial law in Ukraine, it is important to know which social payments are not subject to arrest. This issue has become particularly relevant for individuals receiving social assistance, as blocking accounts can significantly complicate their lives. According to Article 73 of the Law 'On Enforcement Proceedings', there are a number of payments that cannot be arrested.
The category of assistance that cannot be arrested includes:
- assistance for children, which includes payments to single mothers, for a child with a disability, as well as assistance upon the birth or adoption of a child;
- payments in the field of social protection, which provide assistance related to pregnancy and childbirth, for treatment, for burial, as well as material assistance to individuals who have lost their right to unemployment benefits;
- compensatory payments, which include compensation for employee expenses during transfers or business trips, as well as the non-taxable amount of material assistance;
- payments to military personnel, including severance pay for servicemen, one-time assistance in case of death, disability, or partial loss of working capacity.
Particular attention should be paid to accounts with a special usage regime, which are designated for receiving compensation for damaged or destroyed housing. The prohibition of arrest on such accounts is an important step in supporting those affected by the war. Also, according to the temporary rules of martial law, debtors can carry out expenditure operations from an arrested account for an amount not exceeding two minimum wages, which in 2025 will amount to 16,000 hryvnias.
