People's Deputy Yaroslav Zheleznyak suggested changing the rules for business operations during the yellow level of air threat. The initiative concerns employees' actions during alerts, written consent for work, and the ability to move to a shelter without penalties. He reports this on the channel Iron MP.

Work during a yellow alert: what three changes Zheleznyak proposes

According to the deputy, the current order leaves businesses uncertain about coordinating work with the team and responsibility for safety. He describes the situation as particularly difficult for small establishments in houses where there are no suitable premises for shelters.

Zheleznyak proposes to enshrine three positions:

  • to allow work during the yellow level of threat with the consent of the employee;
  • to formalize this consent in writing as a separate document;
  • to leave the employee the right to cease work and move to a shelter without punishment from the employer each time.

The general written consent, as the deputy envisions, should not deprive a person of the ability to change their decision during a specific alert. The employer must respect this choice.

For the red level of threat, Zheleznyak suggests maintaining the mandatory transition to a shelter. The changes he announced are still an initiative and not an approved work order.

Earlier, the deputy also announced seven proposals for businesses that have suffered from shelling. Among them were a moratorium on certain inspections and the simplification of requirements for destroyed documents.

Requirements for shelters: what businesses need to prepare by December 4

Zheleznyak stated that his team is preparing proposals for the government and will seek changes by December 4. This is the date when the transition period for enterprises without shelters ends.

According to the explanation from the Ministry of Economy, the resolution No. 1092 came into force on September 4, 2026. During the yellow level of threat, enterprises with protective structures, permanent or temporary shelters, or in dual-purpose buildings can operate in regular mode.

At the same time, the ministry clarifies: it is not always necessary to build a separate shelter. In cases provided by law, creating a safe space directly in the building is allowed. The corresponding decision must comply with established requirements.

The issue also concerns the payment of time when a person leaves the workplace for safety. According to OLX survey results, in 51% of respondents, staying in a shelter is counted as regular working time, while in 35% this issue has not been discussed.
