According to the Specialized Anti-Corruption Prosecutor's Office (SAPO), the arrest occurred on January 28, 2022, as a significant sum of money was being handed over.

The lawmaker's repeated failure to appear in court led to his detention. His most recent no-show was attributed to a business trip to the Kingdom of Spain. Kuzminykh has now been placed in a temporary detention facility. “The arrest was carried out by NABU detectives in execution of a ruling by the High Anti-Corruption Court due to the accused’s systematic failure to appear in court sessions,” stated the Specialized Anti-Corruption Prosecutor’s Office.
