Oleksii Honcharenko Clarifies: Temporary Investigative Commission Not Authorized to Issue Alerts During Air Raids

According to ХВИЛЯ: Oleksii Honcharenko, a member of parliament and head of the Temporary Investigative Commission (TIC), announced that neither the TIC nor the Law Enforcement Service (LES) has the authority to carry out alert procedures during air raid warnings. This information was confirmed by a letter from the Ministry of Defense addressed to the commission. The TIC is tasked with investigating potential legal violations related to defense matters and human rights observance during martial law.

Honcharenko, representing the European Solidarity party, emphasized that the Ministry of Defense provided recommendations in response to the commission’s inquiry. He highlighted,

“The Temporary Investigative Commission is not permitted to conduct alert activities during air raid alarms. This was the official response to the commission’s request.”

Legal Boundaries During Air Raid Alerts

Honcharenko further stressed that Ukrainian law does not allow stopping, detaining, or restricting individuals in public spaces or blocking their access to shelters during air raid warnings. He explained,

“Considering Ukraine’s security situation, such mobilization practices could be unlawful and pose real dangers both to military personnel and conscripts.”

He noted that the TIC’s clarification provides a definitive legal stance on these actions: “This practice is not supported by existing legislation.”

This clarification underscores the critical need to uphold legal standards during martial law in Ukraine, where citizen safety must remain paramount.
