Motorists Seek Legal Recourse Over Alleged Police Misconduct at Checkpoints

According to ХВИЛЯ: Drivers are growing increasingly concerned about the situation at security checkpoints, where police officers are frequently accused of violating the law, specifically Article 35 of the National Police Act. Engineer and marketer Serhiy Shyshkin and political analyst Yuriy Romanenko have discussed the recurring issues during these stops. Motorists report being stopped without legal justification, having their dashcams turned off, and encountering a general disregard for legal procedure.

Serhiy Shyshkin noted that officers often ignore the law, citing internal directives instead, which raises questions about the legitimacy of their actions. He emphasized that during stops, no legal reason is provided, and the dashcams that could document the interaction are frequently disabled.

“I am not hiding my name... I am willing to show my documents to comply with any lawful request from a police officer. But their lawfulness is now in question: the dashcam is not working, and the reason for the stop is not stated.” - Serhiy Shyshkin

Furthermore, he posed a question to law enforcement representatives: “Tell me, dear representative of the law, did you take an oath? To whom did you swear it? To the people of Ukraine. Then explain to me why you are treating this people of Ukraine in such a strange way?” Such questions point to a profound breakdown in communication and trust between the police and citizens.

Faced with these situations, drivers are now preparing to take their cases to court, as rights violations during checks cannot go unchallenged. The problems reported at checkpoints include:

  • Traffic jams
  • An absence of legal grounds for inspections
  • The widespread disabling of dashcams
  • The manipulation of terminology, such as using 'superficial check' instead of a visual inspection

These factors create a tense atmosphere on the roads and underscore the need for drivers to seek legal protection. This issue highlights the critical importance of law enforcement adhering to legal statutes, especially in a context where public safety and order are paramount. The rise in lawsuits could serve as a catalyst for reforming police procedures and improving community relations. For context, checkpoints have been a widespread feature in Ukraine since 2014, playing a crucial role in security but also becoming a frequent point of public friction.
