Conscription and Equipment Seizures in Ukraine: The Current Situation

According to ХВИЛЯ: Ukrainian businesses, particularly in the agricultural sector, are facing growing challenges from the erroneous mobilization of reserved employees and the seizure of specialized equipment, such as milk tankers. These actions threaten to disrupt critical production and supply chains, which in turn complicates the logistical support for the Armed Forces of Ukraine. Yaroslav Kuts, a lawyer and member of the National Association of Advocates of Ukraine committee, has detailed the legal mechanisms available to help agricultural producers protect their interests. This context is vital for understanding the strain on Ukraine's domestic food security and military logistics during the ongoing conflict.

The Significance and Process of the De-reservation Algorithm

An updated procedure for de-reservation, introduced in December 2025, is designed to safeguard the rights of workers with official exemptions. A critical requirement is that de-reservation documents must be submitted before a mobilized individual completes their Basic General Military Training (BGMT). Despite this formal process, Territorial Recruitment Centers (TCCs) frequently disregard reservation documents due to the pressure of meeting mobilization quotas, creating significant difficulties for companies trying to retain essential staff.

'In my practice, there have been successful cases of specialists being returned from training centers, demonstrating that the rights of reserved individuals can be defended.' Yaroslav Kuts

Yaroslav Kuts further explained that the seizure of equipment often leads to the spoilage of agricultural products and severely disrupts supply chains. This has negative consequences not only for businesses but also for the overall provisioning of the Ukrainian military.

The issues of wrongful mobilization and equipment confiscation highlight the critical need to uphold the rights of entrepreneurs during wartime. Agricultural producers, who are fundamental to the nation's food security, are confronting serious challenges that jeopardize both their operations and the broader support system for the Armed Forces.

The state's response to these problems and the implementation of new protective mechanisms could prove decisive for stabilizing the situation within Ukraine's agribusiness sector.
