Kyiv Prosecutor Demands Demolition of Dnipro Riverside Restaurant
Legal Action Over Land Use
According to Главком: The Kyiv Prosecutor's Office has filed a lawsuit seeking to reclaim a nearly 0.5-hectare plot of land valued at 33 million hryvnias, located on Malozemelna Street in the Darnytskyi district, and to remove an illegally constructed restaurant from it. This site falls within the protective coastal zone of the Dnipro River. The Shevchenkivskyi District Prosecutor's Office in Kyiv brought the case to the Commercial Court of Kyiv, aiming to eliminate obstacles to the municipal land's use.
Prosecutor's Demands
The lawsuit calls for clearing the land of the restaurant, which was built without proper legal authorization. 'On this land plot, a building of nearly 450 square meters, used as a restaurant, has been placed without valid legal grounds. The Kyiv City Council has issued no decisions to transfer the land into ownership or use by any individuals or legal entities, and property rights to the plot have not been formalized as required by law,' the prosecutor's office stated.
Additionally, the prosecutor is seeking to cancel the registration of ownership for the restaurant, which authorities say was constructed illegally. This case is part of broader efforts by the prosecutor's office, which previously succeeded in overturning an illegal property registration in Muromets Park. In the Muromets Park case, the offending company was ordered to demolish the unauthorized structure and return the land to the city. Through these actions, the prosecutor's office continues to actively enforce land use regulations in the capital.
This incident highlights the critical importance of adhering to Ukraine's land laws, particularly regarding the protection of natural resources. The prosecutor's actions may serve as a warning to other entrepreneurs about the necessity of legally securing land and construction rights, potentially preventing similar issues in the future. The prosecutor's office's involvement in this and other comparable cases reflects a growing focus on combating illegal land use in Kyiv.
This recent legal action is part of a broader trend in Kyiv, where authorities are increasingly vigilant about illegal land use. A notable case involved the city successfully reclaiming land in the Zhukiv Island Nature Reserve, emphasizing the importance of compliance with environmental regulations.
