Court Ruling Restores Borodianka Mayor After Year-Long Clash with Council
Oleksandr Sakharuk Reinstated as Head
According to Главком: On June 19, the Borodianka settlement council reinstated Oleksandr Sakharuk as its head, complying with a court order. This decision came during a plenary session of the 91st extraordinary meeting of the 8th convocation council, where deputies voted to enforce the ruling of the Sixth Administrative Court of Appeals from October 25 in case number 320/1916/22.
Sakharuk, now back in his role, stated:
On March 12, I, Oleksandr Sakharuk, was reinstated as head of the Borodianka settlement council, and the Ministry of Justice of Ukraine entered the corresponding record into the Unified State Register. Despite this, a private notary performed a registration action canceling that entry.
The Case of Iryna Zakharchenko
On June 4, the Borodianka settlement council prematurely terminated the powers of its secretary, Iryna Zakharchenko. However, the Unified State Register again lists Iryna Zakharchenko as the head of the Borodianka settlement council. Oleksandr Sakharuk commented on this situation:
Currently, the Unified State Register shows Iryna Zakharchenko as the head of the Borodianka settlement council. Meanwhile, according to council session decisions and administrative acts, this individual was dismissed from her position. Thus, the state register lists as the head of a local self-government body a person whose authority should be subject to separate legal assessment.
Notably, a criminal proceeding has been opened (No. 42026112320000232, dated June 23) regarding the registration action by private notary Yurii Badakhov. It has been stated that an investigation is necessary because the private notary performed a registration action canceling the record of Sakharuk's reinstatement. In connection with this, complaints have also been filed with law enforcement agencies and an appeal has been made to the Ministry of Justice of Ukraine. This situation has sparked significant public outcry and requires further legal review.
The events surrounding Oleksandr Sakharuk's reinstatement as head of the Borodianka settlement council and the disputed status of Iryna Zakharchenko highlight the complexity of legal relations in local governance. The initiation of a criminal case against the notary points to potential violations in the registration process, which could have serious consequences for all parties involved. Future actions by law enforcement and the Ministry of Justice may significantly affect stability in local government and public trust in state institutions.
In light of the ongoing legal battles surrounding local governance, the situation in Borodianka echoes broader issues of accountability and leadership in Ukraine. Similar controversies have arisen in other regions, such as the recent developments involving Hungary's Premier and the Prosecutor General amid a scandal with Oschadbank.
