Legal Challenges Targeting Elon Musk

According to Главком: A U.S. federal magistrate judge has compelled Elon Musk to provide testimony in two class-action lawsuits centered on allegations of voter fraud. These cases stem from Musk’s pledge to award $1 million daily to signatories of an election-related petition. The plaintiffs, Arizona residents Joy Harwick and Jacqueline McAferty, assert that Musk and his political action committee, America PAC, misled voters by promising a random selection process for winners. In reality, they claim, the 18 recipients were deliberately chosen.

Magistrate Judge Susan Hightower, based in Austin, Texas, recommended advancing McAferty’s lawsuit, which accuses the defendants of deceiving voters to collect personal data. During a deposition in February 2026, America PAC director Christopher Young admitted he was taken aback by Musk’s phrasing, stating:

At the same time, the judge recommended dismissing a related claim for breach of contract.

Lotteries and Electoral Ethics

America PAC, established by Musk to bolster Donald Trump’s 2024 presidential campaign, announced in October 2024 a daily $1 million giveaway to those who signed a petition supporting the U.S. Constitution. The petition’s content effectively aligned with Trump’s platform. Voters subsequently sued Musk for failing to pay a promised $100 for signing the petition. Meanwhile, a Pennsylvania court permitted Musk to continue the $1 million voter giveaways.

U.S. District Judge Robert Pitman in Austin will render the final decision on both lawsuits. The unfolding events highlight the complexities of using lotteries as a campaign tool, raising ethical and legal questions about the promises candidates make during elections.
