Suspicion Announced Over Unpermitted Construction

According to Прокуратура Київ: The former head of a private company has been formally notified of suspicion by the Darnytsia district prosecutor's office in Kyiv. The charge relates to the illegal construction of a two-storey annex attached to a business center on Larysy Rudenko Street. In 2020, the company expanded the property from nearly 200 square meters to more than 440 square meters, without securing the required permits and on land parcels it had occupied without authorization. The prosecutor's office has also filed a lawsuit demanding the annex be demolished, and the Commercial Court of Kyiv has opened proceedings in the case.

Case Background

The case dates back to 2015, when an individual acquired ownership of non-residential premises in a multi-story business center. Those premises were later contributed to the charter capital of the company that carried out the annex construction. At no point did the Kyiv City Council allocate the relevant land plots for construction or for the company's use. The unpermitted structure is known to be leased out as a food-service outlet and a shop.

The former company head is suspected of violating Part 3 of Article 197-1 of Ukraine's Criminal Code. The Darnytsia district prosecutor's office has asked the court to order the demolition of the structure, and proceedings have been initiated at the Commercial Court of Kyiv. The case serves as a reminder that building without proper permits carries serious legal and financial risks. In Ukraine, an unauthorized development can lead to a court-ordered demolition and criminal liability, making due diligence essential for anyone planning to expand or alter commercial real estate.
