Hungary’s Stance on the EU’s Temporary Protection Directive

According to Radiotrek — Світ: Hungary has declared its refusal to implement the European Union’s temporary protection directive concerning Ukrainian men of conscription age who have not fulfilled their military service obligations. This move responds to the EU Council’s decision and directive that restrict protection for males aged 23 to 60 unless they can prove compliance with military duties.

The Hungarian government has officially informed the European Commission of its intention to partially disregard this directive. While the EU’s temporary protection framework and Council decisions regulate these protections, Article 7 of the directive grants member states discretion in applying its provisions. Hungary is exercising this option by limiting the directive’s application.

“Member states retain the discretion to decide how to implement the EU Council decision and temporary protection directive.”

Markus Lammerth, European Commission Spokesperson

Since October 8, 2026, the European Union has stopped granting temporary protection to newly arrived Ukrainian men of conscription age who cannot verify military service compliance or legal departure from Ukraine. Hungary is currently shaping its policy on protecting these individuals within the scope of the EU directive.

Consequences for EU Policy and Relations

Hungary’s decision may heighten tensions within the European Union, where adherence to common rules and directives is crucial. At the same time, it underscores Hungary’s effort to maintain sovereignty over immigration policy, a stance that could affect its relationships with fellow EU members and the broader situation of Ukrainian refugees seeking asylum in Europe. This development highlights the ongoing challenges the EU faces in balancing national interests with unified migration and protection policies.

In light of Hungary's recent decision, it is important to consider how the country is also granting exemptions for Ukrainian military reservists from the temporary protection restrictions. This move illustrates Hungary's complex approach to immigration policy and its implications for EU relations, particularly in the context of the ongoing refugee crisis.
