Government Revises Enterprise Reservation Rules: Coordination Center Established and Quotas Reduced to 95%

Changes in the Rules for Enterprise Reservations
Уряд змінює правила резервування підприємств: створено координаційний центр, а квоти знижено до 95%

Updates to Ukraine's Enterprise Reservation Policy

According to ХВИЛЯ: The Ukrainian government has introduced new regulations for reserving key enterprises, following a reassessment of their critical status two months ago. A newly formed Coordination Center has been tasked with overseeing the reservation process, effectively complementing the military administrations' role. This center holds extensive authority, including the power to revoke a company's critical designation and to review such status upon requests from law enforcement agencies. Additionally, any increases in reservation quotas must receive the center’s approval.

Quota Adjustments and Emerging Challenges

Significant changes have been made to reservation quotas. Defense-related enterprises now have their reservation limit lowered from 100% to 95%, while donor program quotas are capped at 50%. These quotas are valid for up to one year, and businesses themselves will decide how to allocate the remaining 5% of unreserved positions. However, this system has revealed vulnerabilities, including corruption risks and misuse of reservation privileges, with some reserved positions not aligning with critical economic needs. Examples of such non-essential roles include:

  • cook
  • cashier
  • pastry chef

Economic expert Polina Marchenko criticized the new framework, arguing it has created fresh opportunities for corruption rather than simplifying the process. She emphasized the "immense and extraordinary" powers granted to the Coordination Center, especially its ability to annul a company's critical status. According to Marchenko,

"the center's authority is so vaguely defined that its interpretation will largely depend on how regulators choose to enforce it"

.

Marchenko also highlighted ongoing criminal investigations linked to abuse of the reservation system, particularly concerning defense and communal enterprises. She stressed the importance of scrutinizing companies that do not fulfill essential economic roles.

"These defense and communal enterprises have been misusing reservations, leading to multiple criminal cases,"

she noted.

Pointing out questionable reserved vacancies, such as a private cook for an elite Kyiv neighborhood family, Marchenko urged Prime Ministerial oversight. "In my view, the Prime Minister should actively monitor who is distributing these reservations so liberally," she stated. These recent policy changes have sparked considerable debate and call for heightened government vigilance.

The amendments to Ukraine’s enterprise reservation system reflect the government's effort to adapt to evolving challenges. Yet, experts warn that the reforms may inadvertently open the door to further abuses. Strengthening oversight of critical enterprises and their functions is increasingly vital as past incidents have exposed significant systemic flaws. Balancing the need to support key economic sectors while preventing corruption remains a pressing priority for the authorities.

The recent adjustments to Ukraine's enterprise reservation policy raise important questions about the broader implications for military exemptions as well. As the government plans to revise military exemption regulations, the establishment of a Coordination Center could lead to similar challenges and opportunities for oversight. Understanding these developments is crucial for businesses navigating the evolving landscape of reservation and exemption policies.
