Legal Firm Challenges Government Over Unpaid Court-Ordered Pensions
Cabinet of Ministers Decree Under Legal Challenge
According to ХВИЛЯ: The law firm 'Network of Law' has filed a legal challenge against Cabinet of Ministers Decree No. 821, which restricted the payment of pensions recalculated by court order. According to the firm's lawyer, Dmytro Korsun, the court has suspended proceedings in several cases, while two cases remain active with hearings scheduled for April 1 and April 8.
Several proceedings were suspended by the court pending the enactment of a ruling from March 4, where lawyer Ivan Khomych acted as a representative. It is crucial to note that if the decree is ruled unlawful and invalid, it will lose its legal force for all individuals from the moment the court's decision takes effect.
“It will not be possible to cite it or apply it. However, it will only be considered void from the moment the court's decision gains legal force,” stated Dmytro Korsun.
Concerns Over Judicial System Functionality
Korsun also explained that the firm chose not to appeal the suspension orders because other active proceedings are still underway. He expressed deep concern about the state of the judicial system, remarking:
“What kind of court is this, what kind of justice can we speak of, if a court makes a decision that gains legal force, passes through multiple instances, yet is never enforced? This is an absolutely egregious situation.”
The case is currently being heard by the Sixth Appellate Administrative Court.
