Support for Parents in Ukraine: When Children Are Obliged to Pay Alimony
According to hvylya.net: Article 51 of the Constitution of Ukraine and the Family Code establish that adult children are obliged to assist their disabled parents. This means providing financial and medical support to those parents who need help, especially if they are retired or disabled.
If parents fail to fulfill their obligations, the court may address the issue of collecting funds for their support. However, children may be exempt from this obligation if they prove that their parents systematically evaded their parental duties.
The right to support arises only for a disabled person who cannot independently secure sufficient living conditions. In some cases, the court may decide to award alimony for the support of parents for a specified period.
When determining the amount of alimony, all aspects of the family and financial situation of the parties are taken into account, including additional expenses necessary for the maintenance of parents.
Should children help their disabled parents ensure decent living conditions, taking into account their needs and capabilities. The law establishes the responsibility of adult children for the financial and moral support of parents in their old age or in case of disability.
