Court Boom: Why Lease Agreements for Land are Massively Terminated in Ukraine
According to hvylya.net: Ukrainian courts are increasingly making decisions to terminate land lease agreements due to tenants violating the requirements for rent indexation. According to lawyer Victoria Koval, the number of such cases has tripled compared to previous periods.
'There is currently a lot of practice in terminating contracts specifically due to the lack of indexation – this has become a sort of loophole for terminating contracts by court decision,' - explains the lawyer.
According to the law, rent must be indexed annually. Many farmers who signed contracts several years ago continue to pay a fixed amount, not taking inflation and the monetary evaluation of land into account.
Experts advise agrarians to review the terms of their lease agreements and adapt the rent to the requirements of the law to avoid contract termination through court decisions.
Ukrainian courts are actively reviewing cases of violations of lease agreement terms due to the absence of rent indexation. Farmers are advised to avoid conflicts with the law by reviewing the terms of their agreements and adjusting payments accordingly.
