Clarifying the Rules on Medical Commission Deadlines

According to ХВИЛЯ: A false claim is circulating that workers with job reservations must undergo a mandatory military medical commission (VLC) by March 28th. This deadline does not exist in law. Under current regulations, there are no new grounds for canceling a reservation due to a failure to undergo a medical examination. The exhaustive list of reasons for canceling a reservation is defined in paragraph 31 of Procedure 76.

Medical Examination Regulations for Reserved Personnel

According to paragraph 63, clause 3 of Procedure N 560, individuals with a valid deferment (job reservation) are not directed to undergo a medical examination. Exceptions to this rule apply to only three categories of people:

  • Individuals previously deemed partially fit who have not undergone a re-examination (excluding persons with disabilities);
  • Individuals being accepted for military service under contract;
  • Individuals who voluntarily request to undergo an examination.

Currently, the functionality of the Diia portal allows for the reservation of workers without an up-to-date VLC conclusion. It's important to understand that if a reserved worker receives a summons for a VLC and does not appear, they may be listed as 'wanted.' A person with a 'wanted' status cannot technically be reserved. Therefore, adhering to the current legal norms and avoiding misinformation is crucial.

In the context of this disinformation campaign about VLC deadlines, it's vital to note that the lack of legal grounds for canceling reservations should prevent unnecessary panic among eligible workers. For context, job reservations are a key mechanism in Ukraine to maintain critical economic functions during the war.
