Attorney's Response to the Accusations
Attorney Yaroslav Kuts has responded to accusations of threatening journalist Marichka Dovbenko regarding an interview she conducted with singer Taras Topolia. Kuts asserts that Dovbenko violated prior agreements by asking prohibited questions about the singer's personal life and then published the interview without his consent. He also stated his intention to resolve the conflict through legal action.
Yaroslav Kuts is both the lawyer and a friend of Taras Topolia. The interview with Topolia took place in late February, with pre-established ground rules limiting certain topics. Specifically, discussion of his marriage, divorce from Olena Topolia, and a scandal with his ex-wife were off-limits. PR manager Olena Harmash was also present during the recording. However, during the conversation, Dovbenko proceeded to ask questions related to these forbidden subjects.
The Conflict and Legal Repercussions
Following the interview, Yaroslav Kuts sent Dovbenko edits and demands to remove specific segments he believed breached their agreement. Despite this, the journalist published the interview on her YouTube channel without Taras Topolia's authorization. In response, Kuts presented Dovbenko with an oral complaint and a demand to take down the video. She, in turn, has accused Topolia's team of applying pressure and filing a complaint against the video.
Marichka Dovbenko received a notification from YouTube about a privacy violation complaint filed against the interview. Yaroslav Kuts declared that the conflict will end in court and with the blocking of Dovbenko's channel. He also published screenshots of their private correspondence to substantiate his claims.
Kuts noted that Taras Topolia had refused similar interviews for months because he did not wish to discuss details of his private life.
“I knew why. Because for months, Taras categorically refused to do such interviews, to dig into the details of his family life,” Kuts stated.
He further emphasized that Dovbenko acted not as a journalist, but as a private individual seeking to boost the popularity of her YouTube channel by exploiting Taras Topolia's personal affairs.
The topics explicitly prohibited for discussion in the interview, as per the agreement, included:
- Marital relations
- The divorce of the couple, Olena and Taras Topolia
Nevertheless, Taras Topolia did comment on his divorce from his ex-wife, the scandal involving leaked private videos, as well as questions about politics and cooperation with Ukraine's military intelligence (GUR). Kuts stressed that Dovbenko failed to adhere to journalistic ethics standards and did not obtain the necessary permission to publish the interview, a fundamental requirement for any journalist.
