Poroshenko’s Lawyers Accuse Officials of Court Interference and Pressure in Sanctions Reversal Case

The defense team of Ukraine’s fifth president, Petro Poroshenko, has formally appealed to the High Council of Justice, the National Anti-Corruption Bureau (NABU), and the Office of the Prosecutor General, alleging undue interference in the judiciary. They claim that Irina Mudra, Deputy Head of the President’s Office, along with Igor Dashutin, Chairman of the Administrative Cassation Court, exerted pressure on the panel of judges handling the case to annul sanctions against Poroshenko.

The hearing faced significant delays after Judge Olga Kashpur was granted leave by an order issued by Dashutin. This postponement caused the April 3 session to be canceled, extending the trial by three months. Poroshenko’s lawyers have also filed motions to recognize him as a victim in the case and have registered additional criminal charges under Articles 364 and 376 of Ukraine’s Criminal Code.

Legal Framework and Case Details

Article 364 addresses abuse of power or official position, while Article 376 covers interference with judicial activities intended to obstruct duties or secure unjust rulings. The defense has urged the High Council of Justice to investigate the circumstances surrounding the judge’s leave order.

During a September 2 session of the Verkhovna Rada’s Temporary Investigative Commission, evidence emerged of external influence on the judges involved. The ruling to revoke sanctions was made by judges Olga Kashpur, Viktoriya Masedonska, and Zhanna Melnyk-Tomenko. Meanwhile, judges Olesya Radyshevska and Mykhailo Smokovych dissented, publishing separate opinions opposing the decision.

Attorney Ihor Holovan emphasized the need for NABU’s criminal investigation into the alleged pressure. The case is currently under review by the Supreme Court’s Grand Chamber.

“Judge Kashpur was granted leave from April 2 to 3 by an order signed by Dashutin. Because of this, the scheduled April 3 hearing did not take place. By timing the judge’s leave precisely when the verdict was to be announced, the proceedings were delayed by three months. This pause provided an opportunity for those seeking to interfere and influence the judges to attempt to sway their decision,” explained Illya Novikov.

The unfolding situation around Poroshenko’s case remains highly charged, with the defense signaling a determined effort to safeguard their client’s rights.

This case highlights ongoing concerns about judicial independence and the risk of political interference in Ukraine’s courts.
