The practice of declaring military obligations in search upon the request of Territorial Recruitment and Social Support Centers (TRSSC) is becoming increasingly common. For many citizens, the appearance of their name in police databases comes as an unpleasant surprise that threatens forced delivery to the TRSSC. Experts in military law explain why a military obligation can end up in the relevant databases and what legal mechanism exists to resolve this issue.



Mechanism for declaring in search: who and on what grounds


It is important to understand that the Territorial Recruitment and Social Support Centers (TRSSC) do not have the authority to declare a person in search in a criminal sense. This requires an appeal to the National Police to determine the person's whereabouts and deliver them to the TRSSC for drawing up a protocol on an administrative offense. Grounds for such an appeal include violations of military accounting rules, such as failing to appear upon a summons without valid reasons, evading military-medical commission, and others.



'When a person is declared in search upon the request of TRSSC representatives to the police, the first encounter with law enforcement may lead to forcible mobilization. This happens when there are problems with military documents or the person does not fulfill obligations related to military accounting,' comment specialists from the law firm 'Prikhodko and Partners.'




Application for removal from search - key protection tool


If you learn about your presence in the search database, ignoring the problem will only exacerbate the situation. The only legal way is to actively protect yourself, which includes submitting a reasoned application to the TRSSC for removal from the search. This is not just a formal request, but a legal document that must be drawn up according to specific requirements. The purpose of the application is to prove that the grounds for the search are absent or have been eliminated.



The content of the application should include:




  • Personal data: Full name, address, contact details.




  • Information regarding declaration in search: case number or date of appeal, if known.




  • Reasons for non-appearance: it is necessary to provide persuasive arguments, examples of documents (for instance, medical) in case of serious circumstances.




  • Request for removal from search: clear demand to exclude data from databases.





'In the application, it should be clearly stated the reasons for non-appearance at the summons/military medical commission. If the reason was important (treatment, family circumstances), relevant documents should be attached as evidence. If there is no guilt, one can acknowledge their mistakes and propose to pay a fine,' recommend lawyers.


Consideration of the application and actions


After receiving the application, the TRSSC checks the documents and makes a decision. If the application is found to be justified, the person is removed from search. Due to this, a fine for violation may also be imposed. In case of refusal, the application can be appealed in court. The participation of a lawyer will help to defend one’s rights and avoid unlawful actions.
