Supreme Court Protects Bank Clients: When Not to Pay for Fraudulent Transactions

Bank Client and Unauthorized Transactions with Card


According to information from the Judicial and Legal Newspaper, Ukrainians may be exempt from liability for fraudulent transactions with payment cards if they promptly notify the bank about suspicious transactions and there is no evidence of their own fault in leaking confidential data. The main principle determining the case is that correct entry of card details and PIN code is not sufficient grounds for accusing the cardholder.


According to the ruling of the Supreme Court, examined in case No. 490/7829/23, the bank cannot collect debt under a loan agreement in cases where funds were withdrawn from the card without the client's consent.


Court Decisions Regarding Client's Fault


The court of first instance partially supported the bank, but the appellate court later recognized the client's fault in compromising card data, yet the Supreme Court overturned this decision. Important principles were established as follows:


  • Presumption of innocence for the client.

  • The burden of proof lies with the bank.

  • Requirements for banking behavior in cases of unauthorized transactions.

  • Critique of the bank's procedural behavior.


This Supreme Court ruling contributes to strengthening the protection of consumer rights in banking services and establishes stricter requirements for evidence of client fault in cases of card fraud.


It was also reported that starting from January 1, 2026, PrivatBank is preparing tariff changes for its clients.
