The Constitutional Court considered the complaint regarding pension indexation: what does it mean for payments

Consideration of the constitutional complaint

The Constitutional Court of Ukraine considered the constitutional complaint filed by Dudkevych Eduard Valentynovych regarding the indexation of pension payments related to the Law of Ukraine on the State Budget for 2023. The case was reviewed on January 14, 2026. In his complaint, Dudkevych challenged the procedure for indexation defined by legislation.

According to the Law of Ukraine No. 2710–IX on the State Budget of Ukraine for 2023, adopted on November 3, 2022, the Pension Fund of Ukraine in the Chernivtsi region made recalculations of pension payments starting from March 2023. The recalculation was based on the Cabinet of Ministers of Ukraine Resolution No. 168 dated February 24, 2023, which defined the procedure for pension indexation.

  • The coefficient for increasing pension payments was 1.197.
  • The increase was limited to the amount of 1500 UAH.

In this regard, the Chernivtsi District Administrative Court denied Dudkevych's lawsuit. Subsequently, the Supreme Court also refused to open cassation proceedings in this case.

Legal grounds for indexation

Additionally, it should be noted that paragraph 8 of Section 'Final Provisions' of the Law of Ukraine on the State Budget of Ukraine for 2023, as well as the Cabinet of Ministers of Ukraine resolutions 'On the indexation of pensions and insurance payments' dated February 24, 2023, and 'On additional social protection for certain categories of persons' dated July 14, 2021, No. 713, defined the legal grounds for indexation. Thus, the consideration of the case in the Constitutional Court became an important stage in the issue of pension payments in Ukraine.

The consideration of Dudkevych's constitutional complaint highlights the importance of legal mechanisms for pension indexation in Ukraine, as this issue directly affects the well-being of pensioners.

The courts' refusal to satisfy the lawsuit also indicates that the existing legal norms regulating indexation remain in force, although they are subject to further discussion. Changes in legislation in this area can have significant implications for social policy in the country.
