Appeals court increases sentence for mother who neglected her disabled son

A mother who failed to care for her disabled son, leading to his death from starvation, has had her prison sentence increased from three to six years. The Vinnytsia Court of Appeals overturned the original ruling after prosecutors challenged it as too lenient.

The case involves a 10-year-old boy with a disability who was completely dependent on others for care. He could not move, speak, or eat on his own. Over an extended period, his mother failed to provide adequate food or medical attention. The boy died in December 2025 from multiple organ failure caused by cachexia due to prolonged malnutrition. Investigators determined the child had gone without food for at least two months, and his mother never sought medical help.

Court ruling and subsequent consequences

The initial trial concluded in March 2025 with a three-year sentence. However, the prosecutor appealed, and a panel of judges at the Vinnytsia Court of Appeals, led by Judge Serhiy Burdeniuk, reviewed the case. The appellate court fully upheld the prosecutor's appeal, overturning the previous sentence.

Under Article 135, Part 3 of the Criminal Code of Ukraine, the mother was sentenced to six years in prison, and under Article 166, to four years. The final combined sentence is six years. Authorities have also charged the director of the municipal social service center, and three other individuals had previously been notified of suspicion.

“For the totality of criminal offenses, the final punishment was set at six years in prison,” the court stated.

This case has sparked widespread public outrage, highlighting the critical need for proper care of children with disabilities and parental accountability.
