Overhaul of Ukraine’s Urban Development Regulations
Ukraine has officially enacted comprehensive reforms in the urban planning sector, designed to streamline regulatory processes. Spearheaded by the Ministry of Communities and Territories Development, the initiative aims to accelerate housing and infrastructure reconstruction projects. The changes include:
- new rules for areas near airfields;
- framework agreements for state-funded projects;
- revision of cost estimation practices;
- liberalization of the permitting system.
Deputy Prime Minister for Reconstruction Oleksiy Kuleba stated,
“Our goal is to ensure that permit procedures do not block project implementation.”
A key challenge arising from the war is that many civilian airfields lack valid certifications. To address this, a new coordination framework has been established among urban planning, aviation, and defense authorities.
These measures represent the first phase of a broader reform. Next steps will involve legislative initiatives focused on spatial planning for communities. Major innovations include:
- introduction of framework agreements for state-financed projects;
- revised approaches to cost estimation;
- ensuring that construction wages reflect real market conditions.
For the first time at the regulatory level, the principle that official documents cannot undervalue salaries has been enshrined.
A database of construction material prices has been created and integrated into the Unified State Electronic System in Construction (USESC). Building clients now have the option to obtain services either from local architectural and construction control bodies or from the state inspection agency. Previously, over one-third of applications for urban development conditions and restrictions were rejected, and the appeals process could take over nine months. The new mechanism allows for swift appeals of rejection decisions, a crucial step in unblocking construction projects.
