Court-Ordered Demolition of Unauthorized Structures in Obolon
Acting on a court ruling, authorities in Kyiv's Obolon district have removed an illegally built fence and parking lot that were occupying communal property. The Obolon District Prosecutor's Office in Kyiv successfully enforced the court decision to clear obstacles preventing public use of a municipal land plot located on Avtozavodska Street. This site had been turned into a vehicle parking area without the necessary permits, prompting the need for its evacuation.
An individual had fraudulently registered ownership of a non-existent non-residential building on this land, with part of that property later sold to a private company. The State Land Cadastre records the plot as covering nearly 0.1 hectares, with an estimated value exceeding 4 million Ukrainian hryvnias. The private company subsequently requested the Kyiv City Council to lease this land, but the council never issued a decision on the matter.
Prosecution and Court Actions
Despite lacking proper authorization, the property owner fenced off the land and set up a parking area for buses. In response, the prosecutor’s office filed a lawsuit seeking to cancel the property ownership registration, invalidate the sale agreement, nullify the land plot registration, and remove the fence.
The court fully granted the prosecutor’s claims, and the ruling has now been executed, freeing the site from vehicles and the illegal barrier.
