Sanctions Sought Against OpenAI

Two major U.S. newspapers, The New York Times and the New York Daily News, have filed a motion requesting sanctions against OpenAI. They accuse the company of hiding evidence in a lawsuit over the alleged unauthorized use of journalistic content to train its artificial intelligence systems. The plaintiffs claim OpenAI concealed data, built a database of 78 million anonymized ChatGPT conversations before the lawsuit was filed, deleted billions of ChatGPT responses after litigation began, and submitted unusable evidence.

The legal battle against OpenAI has been ongoing for two years. During a deposition in April, OpenAI data protection engineer Vinnie Monaco disclosed that internal audits of training data had been conducted. Initially, the plaintiffs demanded access to a sample of 120 million chats, but later agreed to reduce that number to 20 million. The court deemed the materials submitted as inadequate due to hidden fragments that were discovered.

OpenAI's Response and Ethical Concerns

The publications also allege that OpenAI replaced some of the logs in the provided sample. OpenAI representative Drew Pusateri responded by stating:

“The New York Times is trying to gain access to private user conversations because its position in court has weakened.”

He further added that “OpenAI will continue to protect user privacy and the principle of fair use of materials.”

This case has drawn public attention and sparked debate over the ethics of using journalistic material to train artificial intelligence. The investigation is ongoing, and OpenAI’s next steps could have serious consequences for the company and its data protection practices.

Lawsuits involving the use of data for AI training are becoming increasingly relevant amid growing concerns over privacy and copyright. The conflict between OpenAI and media organizations may highlight the need for clearer regulations in this area—rules that would safeguard the rights of journalists and their work. It is important to monitor developments, as the outcome of this trial could have far-reaching implications for both the AI industry and the media landscape.

The ongoing legal disputes surrounding AI technologies highlight a broader issue within the industry. Similar accusations have emerged against major AI companies, with claims of unlawfully utilizing extensive amounts of journalistic content, leading to significant financial implications.
