Pension Fund Accused of Stalling Tactics

Thousands of Ukrainian pensioners are being denied money they are legally owed, following court rulings in their favor. The issue stems from Cabinet of Ministers Decree No. 821, which altered the procedure for executing court decisions on recalculated pensions, effectively blocking payments. A legal battle is now underway in Ukrainian courts to have this decree overturned.

Human rights defenders have initiated the process to annul Decree No. 821, but Ukraine's Pension Fund is actively attempting to halt the proceedings. The government is employing procedural tools to delay hearings, and the consideration of two cases has already been postponed. This situation highlights a recurring challenge in Ukraine's post-Soviet legal system, where state bodies sometimes resist court orders. Advocates have warned they may resort to alternative legal mechanisms to forcibly collect the state's debts to its citizens.

Rights Advocates Voice Serious Concern

Dmytro Korsun, a representative of the human rights defenders, stated that

'The Pension Fund wants to stop the proceedings'
and emphasized that
'the annulment of Decree No. 821 is a matter of principle'
. The delays are causing significant distress among pensioners awaiting payments, as the withheld funds can have severe consequences for their financial stability, especially amidst broader economic pressures.

This case underscores systemic issues within Ukraine's social security framework, where government decrees can directly undermine judicial authority and citizen welfare. The prolonged withholding of pension payments risks exacerbating social tension among retirees. In response, human rights defenders continue to seek pathways to enforce citizens' rights, demonstrating the ongoing struggle to strengthen the rule of law in Ukraine.
