There is a widespread misconception that only physicians working in state-run or municipal healthcare facilities can issue medical certificates for temporary disability (MCTD). In reality, the authority to issue such certificates depends on whether the doctor meets the requirements outlined in the official Procedure, not on the ownership structure of their clinic or whether they have a contract with the National Health Service of Ukraine (NHSU). Doctors in private clinics and those operating as individual entrepreneurs (private practitioners) hold the same rights, provided they comply with the Procedure's conditions.

How MCTDs Are Generated

An MCTD serves as the basis for creating an electronic sick leave certificate. The document is issued by the attending physician who provides medical care to the patient, conducts an assessment of temporary disability, holds a position specified in the Procedure, and has the relevant medical specialization. Importantly, a doctor at a private clinic or a private practitioner has identical authority to issue an MCTD as a physician in a state or municipal institution.

Licensing requirements mandate that all licensed healthcare providers register with the Electronic Healthcare System (EHS) and ensure the entry of electronic medical records deemed mandatory by law. These mandatory records include electronic medical certificates for temporary disability. These rules apply equally to state, municipal, and private healthcare facilities, as well as to private practitioners. Whether or not a provider has a contract with the NHSU has no bearing on these obligations.

Therefore, if a patient is treated by a doctor who is legally entitled to issue an MCTD according to the Procedure, that same doctor must create the medical certificate based on their examination, treatment, or rehabilitation. This is a crucial point to keep in mind to avoid confusion when obtaining medical documents to confirm temporary incapacity for work.
