Environmental Prosecutors File Suit
Kyiv's specialized environmental prosecutor's office has filed a lawsuit demanding the demolition of an illegally constructed building exceeding 1,000 square meters on Trukhaniv Island. The structure was erected without the required permits on land designated as part of the water fund, constituting a clear violation of the law. This case highlights ongoing tensions between development and conservation in Ukraine's capital.
The prosecutor's claim targets a water fund plot of nearly 0.5 hectares on Trukhaniv Island. A foreign-registered legal entity had purchased a 206-square-meter rehabilitation center on the site in 2002, which was subsequently demolished. In its place, a new residential property was constructed, an action also taken without the necessary approval from the Kyiv City Council.
Legal Breaches and Protected Status
This new building was illegally registered, and the surrounding area has been fenced off. It is important to note that Trukhaniv Island is a territory reserved for future protected status, where any economic activity potentially harmful to the environment is prohibited. Construction of any real estate objects on the island is also banned. The Kyiv City Commercial Court has already initiated proceedings in this case, and the trial is ongoing.
This lawsuit underscores the critical importance of adhering to environmental regulations and laws governing the use of water fund lands. As a natural area, Trukhaniv Island requires protection from unauthorized construction that could damage its ecosystem. The outcome of this trial could set a significant precedent for handling illegal developments across Ukraine and strengthen enforcement of environmental protections.
