The Rada adopted a new law on public service. What will change and what to expect for officials

Today, December 10, during a session of the Verkhovna Rada, a new edition of the law "On Public Service" was adopted. The document, authored by Prime Minister Arseniy Yatsenyuk, was developed by specialists from the National Agency of Ukraine for Civil Service, reported TSN.


It should be noted that the adoption of the law was provided for by the Agreement on financing the contract for Ukraine for state development, which was signed on May 13, 2014, in Brussels. The draft law was registered in the parliament on March 30, 2015, but its adoption took place only at the end of the year.


The new law "On Public Service" will come into force on January 1. According to the chairman of the National Agency for Civil Service Issues, Konstantyn Vashchenko, the "reform" of the system will take up to three years.

"There are about 300,000 officials in Ukraine. By 2019, when the civil service reform is completed, there will be about 150,000 officials," he stated. The new edition of the law will help regulate the status of public servants, strengthen personal responsibility of each official, and create conditions for transparent activities of public authorities.


According to the law "On Public Service", from now on:


1. Officials are divided into several categories: - for category "A" you need to have a master's degree, and at least seven years of overall work experience; - Heads of departments of the Cabinet of Ministers, the Presidential Administration, the Council apparatus, etc. will receive category "B"; - All other officials will receive category "C"; - Each category is divided into ranks. These will determine the salary of officials; - A public servant can only become one after passing a competitive selection. A special commission will be established for this.


2. A public servant of category "A" cannot be a member of a political party.


3. Delineation of political and administrative positions.


4. Urgent appointments for senior officials.


5. Reducing the subjective influence of the head on the salary amount (70% - salary, 30% - bonuses and allowances).


6. New position - State Secretary. His responsibilities will include: - implementing the minister's initiatives; - Ensuring continuity, institutional memory, and legality in the ministry's work; - Representation of the ministry as a legal entity; - Appointing and dismissing public servants; granting them ranks.


The adoption of the law will allow, in particular, to strengthen the role of the specially authorized central executive body for civil service issues, as well as its territorial bodies, in order to implement unified state policy and its control.


"In the end, I hope that we will achieve a public service in Ukraine," stated Konstantyn Vashchenko. Officials believe that the new edition of the law is one of the most important points of the coalition agreement and the activity program of several.


Thanks to international commitments, Ukraine has the opportunity to receive financial assistance from the EU in the amount of 2 billion UAH. People's deputy from the "Block of Petro Poroshenko" Mustafa Nayem considers the adoption of the law as the "abolition of slavery in the civil service". According to the politician, for two decades, a Ukrainian official was a hostage of political conjuncture, and his career depended on connections, clans, anything but their professionalism.


Meanwhile, the People's Deputy from the "People's Front" Mykhailo Khmel supported the positive assessment of his colleague and noted that the new law creates conditions for Ukrainians who want to work for the state and not be "victims of political confrontations" in power.
