Restaurants Adding Generator Fees to Bills
Social media in Ukraine is buzzing over a photo of a restaurant receipt with a separate line item charging for 'generator operation.' In response, the State Service of Ukraine on Food Safety and Consumer Protection (Derzhprodspozhyvsluzhba) has issued a clarification on the legality of this practice. Under Ukrainian law, specifically the Law of Ukraine 'On Consumer Rights Protection,' businesses are required to provide customers with complete, accurate, and clear information about goods, services, and their prices.
The watchdog stated that including a generator fee on a bill may violate the law if the customer did not order this service and was not informed of its cost in advance. If clear pricing information is not provided, an establishment can be fined 30% of the value of the goods or services sold, but not less than five non-taxable minimums, which amounts to no less than 85 hryvnias. To date, the State Service has not received any consumer complaints regarding generator fees being added to restaurant checks.
Andrii Kreitor, a representative of the State Service, emphasized that a generator is a tool for ensuring a business's uninterrupted operation, not a standalone service for the customer.
The Critical Need for Transparent Pricing
He stressed the importance of transparent pricing, proper customer notification, and adherence to legal requirements as the foundation of trust between business and buyer, especially under today's challenging conditions. This situation highlights the broader economic pressures businesses face due to ongoing infrastructure challenges.
Separately, the Ministry of Finance has proposed that from 2027, single tax payers with an annual turnover exceeding 1 million hryvnias be required to register as VAT payers. This proposal could impact the operations of small businesses and sole proprietors across the country. However, the immediate focus of public discussion remains on transparency in pricing and consumer protection within the restaurant industry.
The controversy over generator fees underscores the vital importance of businesses complying with consumer law and clear pricing standards. As noted by the State Service, failure to follow these rules can lead to fines for establishments, damaging their reputation and customer trust. The discussion of the Finance Ministry's new VAT initiatives may also affect the market, creating additional challenges for small businesses that require attention from the state and society.
