Ukraine to Sharply Increase Penalties for 'Envelope' Wages Starting February 2026

Upcoming Changes to Ukraine's Employment Legislation

Beginning in February 2026, Ukrainian employers will face significantly higher fines for hiring workers off the books. Paying salaries 'in envelopes' or allowing work without a formal contract will result in substantial financial penalties for businesses. These fines are tied to the minimum wage, which will be set at 8,647 UAH as of January 1, 2026. Penalties are calculated per each unregistered employee, potentially leading to serious costs for companies. This crackdown is part of a broader effort to formalize the economy and improve tax collection.

Penalty Amounts

For a first offense of employing someone without a contract, a legal entity faces a fine of ten times the minimum wage, or 86,470 UAH. Individual entrepreneurs (FOPs) may receive only a warning for a first violation. However, for a repeat offense within two years, the fine for any employer, including FOPs, will be thirty times the minimum wage—259,410 UAH. The discovery of four 'shadow' employees could result in a total fine exceeding 1 million hryvnias.

Furthermore, Article 41 of the Code of Ukraine on Administrative Offenses establishes personal liability for company officials and FOPs. For failing to have contracts with staff, an official can be fined between 8,500 and 17,000 UAH (500-1000 non-taxable minimums). A repeat violation within a year raises the fine for the official to between 17,000 and 34,000 UAH. The State Labour Service of Ukraine has announced it will intensify inspections in 2026, signaling a likely increase in enforcement actions against non-compliant employers.

The introduction of these new penalties is a key component of the Ukrainian government's strategy to legalize labor relations and enhance social protections for workers. These measures are expected to encourage businesses to formalize employment contracts, which should increase budget revenues and reduce the shadow economy. The State Labour Service's reinforced oversight underscores the government's intent to actively combat violations of labor law.
