Court Decision on a Land Plot in Kyiv

A court has returned a plot of land within the Zhukiv Island nature reserve to the territorial community of Kyiv, after it was illegally transferred into private ownership back in 2009. The lawsuit was filed by the Specialized Environmental Prosecutor's Office of the Kyiv City Prosecutor's Office, which successfully demonstrated the unlawfulness of the transfer. Courts at all three levels agreed with the prosecutors' position, and the Supreme Court upheld the rulings of the lower courts.

The land plot, covering 0.0932 hectares, is partially located within the water area of a Dnipro River bay and the local landscape reserve "Zhukiv Island." This reserve was established in 1999 by a decision of the Kyiv City Council. The land in question falls under Ukraine's water and nature reserve fund categories.

In 2009, the Kyiv City Council transferred this plot into private ownership for an individual to build and maintain a residential house, along with utility buildings and structures. Over the years, the plot was repeatedly resold through purchase agreements, with some owners including citizens of the Russian Federation.

Significance of the Land Plot's Return

Returning this land marks a crucial step in safeguarding the capital's ecological assets. The press service of the Kyiv City Prosecutor's Office highlighted the importance of this decision for preserving the natural environment in the region.

"This case underscores the importance of adhering to environmental norms and legislation in Ukraine, especially when it comes to conserving natural resources in major cities."

Restoring community rights to ecologically valuable land plots could set an important precedent for further protection of protected areas. This ruling may also encourage stricter oversight of land transactions occurring within nature reserve zones.
