Studio Director Found Guilty Over Unauthorized Use of Police Uniforms in Comedy Show

A court in Kyiv has convicted the director of Diesel Studio LLC for illegally using National Police uniforms during the filming of a comedy show. The verdict followed an administrative complaint filed by the Pechersk Police Department of the National Police in Kyiv, which was prompted by YouTube videos titled 'Police Cowards: Shame of Ukraine' and 'New Mindich Tapes: Corrupt Officials Get What They Deserve.' The court determined that actors in the show wore official police headgear, uniforms, insignia, sleeve patches, and badges, violating Ukrainian law.

The judge declined to impose a fine ranging from 34,000 to 51,000 hryvnias due to the expiration of the statute of limitations for administrative penalties. The director's lawyer argued that the case infringed on creative freedom, citing Articles 15 and 54 of Ukraine's Constitution and European Court of Human Rights precedents. However, the court rejected these claims, stating that artistic expression is not an absolute right.

Legal Violation and Accountability

The court emphasized that using authentic police headgear, uniforms, patches, and badges—approved under Cabinet of Ministers Resolution No. 823—breached Article 5-1 of Ukraine's Law on the National Police. Earlier in June, the National Police sent a letter to Diesel Studio LLC demanding an end to the use of police attire, but the production head failed to comply.

According to the administrative report, wearing the uniforms created the false impression that the individuals were affiliated with the National Police. The court noted that to hold a legal entity or its director liable, it is sufficient to prove the unauthorized use of police insignia, regardless of intent. Consequently, the director's actions were deemed a violation beyond mere artistic expression.

The co-owners of Diesel Studio LLC are Yehor Krutoholov, Oleksiy Blanar, and Mykhailo Shynkarenko, with Shynkarenko serving as the company's director.

This case highlights the strict enforcement of laws governing the use of official uniforms, particularly in cultural and entertainment projects. Ukraine's legislation clearly regulates the use of National Police attire to prevent misuse and public deception. At the same time, the ruling has sparked debate over the boundaries of creative freedom in Ukraine and the responsibility of content creators to comply with the law.
