Case Transferred to Shevchenkivskyi District Court
On March 10, Judge Serhiy Vovk of Kyiv's Pecherskyi District Court ordered the transfer of a lawsuit filed by businessman Timur Mindich against Member of Parliament Yaroslav Zheleznyak. The case, which concerns the protection of honor, dignity, and business reputation, was initially filed on March 5. The court's automated case distribution system had assigned Judge Vovk to preside over the matter on March 9. However, Judge Vovk ruled the case fell outside his court's jurisdiction, as official state demographic records show Zheleznyak's registered residence is in a dormitory located within the Shevchenkivskyi district of Kyiv. Consequently, the lawsuit has been forwarded to the Shevchenkivskyi District Court of Kyiv for further proceedings.
Plaintiff's Demands and Legal Implications
In his suit, Timur Mindich demands that Yaroslav Zheleznyak publicly retract allegedly false information disseminated on a YouTube channel and a Telegram channel. The plaintiff also seeks a court order compelling the defendant to pay symbolic moral compensation of 200 hryvnias. The judge's ruling to transfer the case can be appealed to the Kyiv Court of Appeal within a 15-day period.
Judge Serhiy Vovk is a figure with a notable judicial history. In 2012, he sentenced former Interior Minister Yuriy Lutsenko to four years in prison and later permitted Andriy Portnov, a former deputy head of Viktor Yanukovych's Presidential Administration, to recover 7 million hryvnias from the state. In April 2021, the Supreme Court upheld a prior appellate court decision that cleared Vovk of charges related to issuing knowingly unjust court rulings.
Under Ukrainian procedural law, a court must transfer a case to another court if it determines the matter falls under the territorial jurisdiction of a different judicial body. The lawsuit filed by Timur Mindich was deemed to be within the territorial jurisdiction of the Shevchenkivskyi District Court of Kyiv, not the Pecherskyi District Court where it was initially filed.
