Mass Reinstatement to Ukraine's Military Registry
Ukrainian authorities are reinstating thousands of citizens to military draft lists without prior notice, reversing their previous status of being medically unfit for service. This is primarily due to ongoing anti-corruption investigations by law enforcement agencies, including the State Bureau of Investigation and the Prosecutor's Office, and reviews conducted by the Central Military Medical Commission (CMMC), which holds the authority to overturn the rulings of lower-level commissions. This process reflects the state's intensified efforts to bolster military personnel amid the ongoing conflict.
According to attorney Oleksiy Mendrukh, individuals often only discover their status has changed when stopped by a patrol. In some cases, arrest warrants may even be issued. As part of anti-corruption measures, law enforcement officers are seizing military service records from Territorial Recruitment Centers (TRCs) and local military medical commissions (MMCs). Following these seizures, the TRCs independently reinstate individuals to the draft rolls. This affects both those who may have obtained their 'unfit' status illegally and those with legitimate illnesses or disabilities, though authorities reportedly do not summon the latter group for questioning.
Challenges in Contesting Reinstatement
Furthermore, the Central Military Medical Commission (CMMC) can initiate reviews and cancel the conclusions issued by lower-level commissions. When this happens, a person previously deemed unfit is returned to the draft registry without any warning. TRCs lack the authority to overturn MMC decisions; only the CMMC, a Regional MMC, or a court can do so. Oleksiy Mendrukh noted that TRCs typically respond to inquiries by stating:
“Your documents are at the disposal of a law enforcement agency, so we cannot help you.” - Oleksiy Mendrukh
The lawyer also emphasized that if a person has questions about their reinstatement, they have the right to contact the TRC to clarify the grounds for it, especially if it appears unwarranted. “The Central MMC requested documents, reviewed them, and found some issues—either something was filled out incorrectly by mistake, or some tests were not completed,” Mendrukh stated.
Consequently, the situation surrounding reinstatement to the military draft in Ukraine is causing significant concern among citizens who may find themselves at risk without warning.
This development highlights the growing tension within Ukrainian society, where military conscription and readiness have become critically important during a prolonged war. Citizens who believe their rights are being violated may face considerable hurdles in appealing these decisions, potentially leading to social strain and eroding trust in state institutions. While government bodies aim to combat corruption in the draft system, the methods employed are raising serious questions about their fairness and transparency.
