Ukraine Introduces Major Changes to Private Property Construction Regulations
In a sweeping reform, the Ukrainian government has fundamentally revised the rules governing construction on private plots. Under Cabinet of Ministers Resolution No. 305, adopted on March 4, 2026, the process has been streamlined for buildings up to 200 square meters and no more than two stories high. Notably, outdated building passports for such projects have been abolished, replaced by a new “construction intent scheme.”
This scheme is prepared by certified architects or engineers and includes key details like the exact building location, facade plans, and utility connection points.
“Instead of spending time gathering numerous certificates, you now only need a construction intent scheme, prepared by a certified architect or engineer—qualified professionals,” officials stated.The collected data is immediately uploaded to the state electronic system, significantly speeding up the process.
“It’s much faster, but now the government can monitor every stage of construction in real time,” experts note.
New Restrictions to Protect Neighbors
Alongside cutting red tape, the authorities have introduced strict limitations to safeguard adjacent properties. The following are now prohibited:
- erecting tall fences or structures that could block sunlight or impede ventilation for neighbors;
- construction work or land-use changes that cause flooding on neighboring plots or generate excessive noise.
Before installing simple canopies, gazebos, or rearranging pathways in the yard, experts recommend discussing plans with neighbors in advance and obtaining written consent.
