The press service of the Ministry of Justice of Ukraine reported on the sanctions awaiting parents who evade alimony payments, reports 'Hvylya'.
According to part two of Article 51 of the Constitution of Ukraine, parents have an obligation to support their children until they reach adulthood, which forms the basis for protecting the rights of minors to receive financial support.
Two ways of collecting alimony
- The voluntary procedure involves the conclusion of a notarized agreement between the parents, the violation of which leads to alimony being collected through the executive inscription of a notary.
- The judicial procedure is applied in the absence of agreement between the parties, and the court's decision on the collection of alimony becomes the basis for opening enforcement proceedings.
Restrictive measures for debtors
When arrears exceed the amount of payments for four months, such sanctions as a ban on leaving Ukraine, restrictions on driving vehicles, and others automatically apply to debtors.
Parents who fail to fulfill their alimony obligations may face community service, fines, and imprisonment. The collection of alimony can occur either through a court decision or through voluntary signing of a notarized agreement between parents.
The Ministry of Justice outlined the strict measures that could be applied to parents who evade alimony payments. Sanctions can include prohibitions on leaving the country, restrictions on vehicle operation, as well as fines and even imprisonment. It should be noted that the failure to pay alimony can have serious consequences for parents who do not fulfill their obligations to their children.
