From 2027, the approach to issuing sick leave in Poland will change: employees with multiple jobs will no longer automatically receive it for all employers. The new regulation has already raised concerns among experts who predict potential problems at the start. This is reported by "inPoland".
Sick leave in Poland 2027: what will change for employees
The new rules foresee a different approach to assessing work capacity. If a person works at several jobs simultaneously, the doctor will determine whether they can perform duties at each of them separately.
Now, sick leave will only be granted for the job that the employee physically cannot perform due to illness or injury. If other work is available, exemption from it is not provided.
The main changes are as follows:
-
sick leave may not cover all jobs simultaneously
-
the decision depends on the type of responsibilities performed
-
working conditions or place of work are not taken into account
-
each case will be considered separately.
ZUS emphasizes that the assessment will be conducted individually, taking into account the specific situation of the employee.
New sick leave rules ZUS: who will be affected
The Ministry of Family, Labor, and Social Policy clarifies that the new system will only apply in narrow cases. It concerns employees who:
-
officially work for at least two employers
-
have insurance at each place of work
-
perform different types of tasks
-
have lost the ability to perform only one of the jobs.
Thus, if the nature of the illness does not prevent performing other duties, the employee must continue to work where possible.
Experts warn that this model may create confusion, especially at the initial stage of implementation, as doctors will have to assess not only health condition but also the specifics of each job.
Previously, the system operated more simply: sick leave was automatically extended to all workplaces regardless of the nature of the work. The new rules aim to make the approach more flexible but may complicate practical application.
