The Patent Situation in Ukraine's Defense Industry
Over the past ten years, from 2013 to 2023, Ukraine has not registered a single patent in the defense industry, despite the fact that hundreds of patents have been privately filed. This situation, which indicates certain shortcomings in intellectual property management, began to change thanks to new state initiatives. In particular, the establishment of the Intellectual Property Office at the Ministry of Defense has been an important step in improving the situation.
New Initiatives and Changes in the Defense Sector
Until 2022, grassroots innovations in the defense sector in Ukraine remained at a tactical level, and until 2025, the country adhered to the Soviet model of intellectual property management, which hindered the development of defense technologies. However, on October 13, 2023, Resolution No. 1310 was adopted for an experimental project aimed at changing this situation. The Intellectual Property Office, which started operating a few months ago, is designed to facilitate more effective idea exchange and commercialization of innovations in the defense sphere.

Currently, the Ministry of Defense has achieved centralized allocation of funding from the state budget, as mentioned by Kateryna Nalyvaiko. This is an experimental project aimed at rapid scaling of production, emphasizes the representative of the Ministry of Defense. Now Ukraine has the opportunity to implement a European model that involves open exchange of ideas and promotes commercialization, unlike the NATO model characterized by security and a tendency towards information secrecy.
Changes in approaches to defense innovations may become an important factor for the development of the Ukrainian defense industry, which, in turn, will positively affect national security. The implementation of new initiatives and models of intellectual property management can lead to significant progress in this area.
The introduced changes in the management of intellectual property in Ukraine may become key to integrating innovations into the defense industry, which is critically important amid modern security challenges. The creation of new mechanisms for patenting and commercializing military technologies can stimulate the development of domestic startups and attract foreign investment, which in turn will enhance the country's defense capability.
