Mobilization Exemption: Who Will Receive a Six-Month Deferral

In Ukraine, men subject to mobilization may be exempted, but some may receive an exemption to ensure the uninterrupted operation of critical enterprises. The exemption is granted for only six months, with the possibility of re-exemption. This decision aims to maintain the functioning of key institutions under challenging circumstances.

According to new rules, officials of state authorities and local self-government are exempt from conscription throughout the entire mobilization period. Employees of critical enterprises receive this exemption for six months; however, it may be revoked in the event of:

• loss of critical enterprise status;
• expiration of the deferral period;
• suspension of the employment contract;
• termination of the employee.

It is important to note that during vacations, labor relations are not terminated, hence the exemption remains valid.

However, not all employees can take advantage of the exemption. In particular, people who work unofficially or earn less than 20,000 hryvnias are not eligible for exemption, except for employees in the public sector, medicine, and energy. The Cabinet of Ministers has also adopted a resolution on 100% exemption for critical enterprise employees in frontline areas, aimed at strengthening their security and operational stability.

Preferential Exemption and Protection of Critical Sectors

Moreover, to address issues with military accounting, a preferential exemption for 45 days is available. According to Marina Bekalo, this mechanism allows for the uninterrupted operation of state institutions.
