Czech Republic Allows Reapplication for Temporary Protection: Important Restriction for Ukrainians

Ukrainians who have refused temporary protection in the Czech Republic, did not renew it, or lost their status can reapply. However, the previous status will not be automatically restored, and decisions will be made based on current requirements. A similar principle applies to reapplication for protection in the EU. How to Reapply for Temporary Protection in the Czech Republic

A prior voluntary refusal of the status does not deprive a Ukrainian of the right to apply for temporary protection again. This also applies to those who did not renew it in time or lost it for other reasons.

However, the new application will be treated as a separate submission. Migration authorities will verify whether the person meets the requirements that are in effect at the time of resubmission.

Therefore, the mere fact that a Ukrainian previously had temporary protection in the Czech Republic is not sufficient for its automatic return. A positive decision on the reapplication is not guaranteed.

This is particularly important in light of changes to migration rules. Throughout 2026, the Czech Republic tightened temporary protection conditions, especially regarding actual residence in the country and obtaining aid.

Which Benefits Will Not Be Restored After Reapplication for Protection

Reapplication for status does not mean that all related benefits will restart from the beginning.

One of the main examples concerns state medical insurance. If a person has already used the 90 days of insurance provided by the state during their initial protection period, this period will not be granted again upon reapplication.

Thus, the termination of status and new application does not 'reset' the used time benefits. This needs to be considered by Ukrainians who plan to refuse protection in the Czech Republic, move to another country, and later return.

Ukrainians should also differentiate between temporary protection and a special long-term residence permit. In 2026, the Czech Republic opened registration for long-term permits for part of the Ukrainians who meet the established requirements.

Thus, it is possible to reapply for temporary protection in the Czech Republic, but the application will be checked according to the rules in effect at the time of submission. There is no automatic restoration of status or reallocation of already used benefits.
