New Resolution from the Cabinet of Ministers of Ukraine

According to ХВИЛЯ: Under Cabinet of Ministers Resolution No. 692, adopted on May 30, 2026, central authorities and regional military administrations must review all critically important enterprises by July 1, 2026. This deadline comes earlier than businesses had anticipated-many expected their critical status to remain valid until September 1, 2026. However, during a meeting on June 5, 2026, with representatives from the Ministry of Economy, it was announced that July 1 could mark the date when many companies lose their critical designation.

Updated Criteria for Critical Status

Under current regulations, any decision recognizing a business as critically important that is still in effect as of June 2, 2026, remains valid only until September 1, 2026, at the latest. Those with mobilization deferments should closely monitor changes to the criteria, as their critical status could be revoked earlier than expected. If a regional military administration removes the specific criterion under which a company was granted critical status, that status must be canceled.

Experts advise businesses to:

  • watch for new criteria as they are published;
  • analyze their content thoroughly;
  • if the criterion used to secure a deferment is no longer valid, submit a fresh set of documents.

The Ministry of Economy has pledged to review new document packages within 10 business days. Consultants have already sent an inquiry to the Ministry requesting official clarification on the updated requirements and potential changes.

This development highlights the need for businesses to adapt quickly to evolving legislation. Companies holding critical status must actively track updates to the criteria, as their designation may change sooner than anticipated. This will create additional challenges, requiring timely responses to preserve legal protections related to mobilization.

As the deadline approaches, businesses must remain vigilant about their critical status. The recent announcement regarding the need for revalidation underscores the urgency for companies to reassess their compliance with the updated criteria.
