Separating Individual Utility Accounts

According to ХВИЛЯ: Co-owners of a property now have the right to split their communal utility accounts. This allows each owner to receive an individual bill corresponding directly to their share of ownership, a right that exists regardless of whether a co-owner participates in paying the bills. The separation process can be initiated by submitting an application to the service providers, and if they refuse, the matter can be pursued through the courts.

Property Rights and Reimbursement of Costs

Ownership rights to real estate are perpetual, meaning each co-owner is entitled to their share. Once accounts are separated, utility bills will be issued in strict proportion to these ownership stakes. For instance, if one owner holds a 2/3 share of an apartment and another holds 1/3, their respective bills will reflect that exact ratio.

In cases where one co-owner has been covering the utility costs for everyone, they have the right to seek compensation from the other owners through the courts. This legal recourse prevents situations where one person bears the full financial burden for communal services without a way to get reimbursed.

It is also crucial to note that inherited property can come with inherited debts, including unpaid utility bills. According to Article 1218 of the Civil Code of Ukraine, an inheritance includes all the rights and obligations that belonged to the deceased at the time the inheritance was opened. It is not possible to accept the assets while refusing the associated financial liabilities. Such conflicts most commonly arise between former spouses or heirs, highlighting the importance of properly formalizing ownership rights and understanding potential debts. This system of separate billing is a significant development for property co-ownership, common in multi-family buildings and inherited estates.

Granting co-owners the ability to split utility accounts is a major step in regulating relations between property owners. This innovation helps avoid conflicts and ensures fairness in the financial obligations arising from joint ownership. Furthermore, the issues surrounding inheritance and debt underscore the necessity of a careful approach to property rights formalization to prevent unexpected financial burdens in the future.
