The Constitutional Court Decides the Fate of Court Fees: What Will Change for Millions

According to Конституційний суд: Today, the court examined the issue of collecting court fees for filing an appeal or cassation complaint against a court ruling. The Supreme Court of Ukraine requested the Constitutional Court to check the legislation for compliance with the Constitution of the country.

During the session, the judges learned that the disputed provision of the law may restrict the right to a fair trial. The Supreme Court supports that there is no fee for submitting a court fee application; however, a fee is still charged for appeals or cassation complaints.

According to the petitioners, this contradicts the Constitution as it limits access to a fair trial in administrative cases.

What Did the Court Decide?

The Supreme Court emphasized that the Constitutional Court had previously declared similar provisions unconstitutional. After a detailed review of the case, a closed part of the session took place to make a decision. Representatives of various branches of power were present at the session.
